I have always loved the idea of birth. When someone gives birth they may feel all of this pain or uncomfortable feelings but once you are holding your child for the first time you realize everything you felt was worth it in the end. This is no different when you give birth unassisted.

We want everyone to feel empowered and have the birth they have always dreamed of. In order for that to happen, we know that all birth options should be known and explored. That includes unassisted birth which is often left out or forgotten. We want to start by telling you that unassisted birth is legal in all 50 states.

Unassisted birth is legal

I want to make sure it was nice and big so everyone knows from the start that it is legal in all 50 states to have an unassisted birth. While some states have laws or restrictions for midwife care those do not apply to an unassisted birth.

Birth Certificate Requirements

How you obtain a birth certificate and the records or proof they ask of you may vary on each state and sometimes down to the county you live in. I do recommend you look into the matter beforehand because once the baby arrives no one wants to be running around trying to get people on the same page. We have started to great a guide for each state requirements and try to update as much as possible but have found it changes from one county to another.

Prenatal Care

This too is a personal choice. Some choose to do their own prenatal care while others choose to see a provider for the pregnancy care. Either way, it's up to you to decide how much or little care you would like. I feel like headlines should read "Unassisted Birth Legal in all 50 States" to hopefully help with some of unnecessary calls and concerns. We know our family loves us and wants the best for us but most of the time only you know what is best for you. Only you know what your body is telling you it needs.

  1. Hello! I am a birth doula, and I currently have a client planning an unassisted birth. While I completely support this practice and very much desire to attend the birth, many people have told me that I should not because of potential legal action taken against me for attending. I would love to hear from anyone who has had an UB with a doula, or who is a doula who has attended. Thanks so much for this awesome resource!

    1. Simply have a form ready to sign that you are not liable.

      1. Honestly even if you have contract and waivers you can be sued regardless of the births you attend. Make sure you client is educated and they know you are not there in place of a midwife or other birth professional.
